  • We continuously improve AllRentalz while respecting your privacy and ownership of your information.

1. Agreement


Welcome to AllRentalz, a Software-as-a-Service ("SaaS") platform owned and operated by Topcone Inc. ("Topcone," "AllRentalz," "we," "our," or "us").

These Terms of Service ("Terms") govern your access to and use of the AllRentalz website, software platform, mobile applications, APIs, and related services (collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.



2. Eligibility


The Services are intended for business use. By using AllRentalz, you represent that:

  • You are at least 18 years of age.
  • You have the legal authority to enter into this agreement.
  • All registration information you provide is accurate and complete.
  • You will maintain accurate account information.



3. Description of Services


AllRentalz provides cloud-based software designed to help businesses manage rental operations, including, but not limited to:

  • Customer management
  • Reservations
  • Dispatching
  • Deliveries and pickups
  • Equipment and asset tracking
  • Dumpster rentals
  • Storage container rentals
  • Storage unit management
  • Equipment rentals
  • Driver assignments
  • Inventory management
  • Invoicing and billing
  • Reporting and dashboards
  • Mobile applications
  • Administrative tools
  • AI-assisted features
  • Third-party integrations

The Services may evolve over time, and features may be added, modified, or discontinued.



4. Trial Accounts


Topcone may offer a free trial.
No credit card is required unless otherwise stated.
At the end of the trial period, access may be suspended until a paid subscription is activated.
Trial accounts are provided "AS IS" without warranties.



5. Subscription Plans


Access to AllRentalz requires an active subscription unless otherwise agreed in writing.
Subscription pricing is published on our website or provided in a written quotation.
Topcone may introduce new subscription plans or modify pricing for future billing periods upon prior notice.



6. Billing and Payments


Customers authorize recurring charges for subscription fees.
Payments are processed through third-party payment providers selected by the customer.
AllRentalz does not store payment card information.
If payment cannot be processed, we may suspend or terminate access after providing reasonable notice.



7. Cancellation


Customers may cancel their subscription at any time.
Cancellation will become effective at the end of the current billing period unless otherwise specified.
Annual subscriptions may be refunded on a prorated basis for the unused portion, subject to any applicable written agreement or promotional terms.
No refunds are provided for monthly subscriptions except where required by law.



8. Customer Responsibilities


Customers are responsible for:

  • Maintaining account security.
  • Protecting passwords.
  • Managing employee access.
  • Ensuring information entered into the system is accurate.
  • Complying with all applicable laws.
  • Obtaining necessary permissions from their own customers.

Customers are solely responsible for the operation of their business and decisions made using information generated by the Services.



9. Customer Data


Customer Business Data remains the exclusive property of the customer.
Topcone acquires no ownership interest in Customer Business Data.
Customers may export their information using available system functionality.
Upon termination, customer data may be retained temporarily in accordance with our Privacy Policy before permanent deletion.



10. Confidentiality


Topcone recognizes that Customer Business Data may contain confidential business information.
We will use commercially reasonable efforts to protect such information and limit internal access to personnel who require access for support, maintenance, security, or legal compliance.



11. Artificial Intelligence Features


Certain Services may include AI-assisted functionality.
These tools are intended to assist users by improving productivity, searching data, generating reports, or assisting with internal query generation.
AI-generated information should be reviewed by users before making business decisions.
Customer Business Data is not used to train public AI models.



12. Third-Party Services


The Services may integrate with third-party providers, including but not limited to:

  • Stripe
  • Square
  • PayPal
  • Authorize.Net
  • QuickBooks
  • Mapping providers
  • SMS providers
  • Email providers
  • Other customer-selected integrations

Topcone is not responsible for the availability, security, pricing, functionality, or policies of third-party services.



13. Availability


We strive to maintain reliable access to the Services. However, uninterrupted availability cannot be guaranteed. Temporary interruptions may occur due to:

  • Scheduled maintenance
  • Emergency maintenance
  • Internet outages
  • Cloud provider outages
  • Third-party service interruptions
  • Security events
  • Force majeure



14. Updates


Topcone may update, improve, enhance, or modify the Services at any time. Updates may include:

  • Security improvements
  • Performance enhancements
  • Bug fixes
  • New functionality
  • User interface improvements

Customers will receive these updates as part of their subscription unless otherwise stated.



15. Intellectual Property


AllRentalz, including its software, source code, user interface, documentation, graphics, trademarks, and related intellectual property, remains the exclusive property of Topcone Inc.
Customers receive a limited, non-exclusive, non-transferable license to use the Services during an active subscription.
No ownership rights are transferred.



16. Prohibited Uses


Customers may not:

  • Reverse engineer the software.
  • Copy or resell the platform.
  • Attempt unauthorized access.
  • Upload malicious software.
  • Interfere with platform security.
  • Use the Services for unlawful purposes.
  • Attempt to access another customer's information.
  • Circumvent licensing restrictions.
  • Use automated systems to abuse or overload the platform.



17. Suspension


Topcone may suspend or terminate access if:

  • Subscription payments remain unpaid.
  • These Terms are violated.
  • Illegal activity is suspected.
  • Customer actions threaten platform security.
  • Excessive use negatively impacts other customers.

Whenever reasonably possible, Topcone will provide notice and an opportunity to correct the issue before suspension.



18. Backups


Topcone performs routine backups to support disaster recovery.
Customers remain responsible for maintaining copies of records they are legally required to retain.



19. Warranties


The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, Topcone disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted or error-free.



20. Limitation of Liability


To the fullest extent permitted by law, Topcone Inc., its officers, employees, contractors, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • Loss of profits
  • Loss of revenue
  • Loss of goodwill
  • Business interruption
  • Loss of business opportunities
  • Loss of anticipated savings
  • Data corruption
  • Data loss
  • Loss arising from customer input errors
  • Operational decisions made using reports or AI-generated insights

Topcone's total aggregate liability arising out of or relating to the Services shall not exceed the total subscription fees paid by the customer during the twelve (12) months immediately preceding the event giving rise to the claim.



21. Indemnification


Customers agree to defend, indemnify, and hold harmless Topcone Inc., its officers, employees, affiliates, and licensors from any claims, damages, liabilities, costs, or expenses arising from:

  • Customer misuse of the Services
  • Violation of these Terms
  • Violation of applicable law
  • Infringement of third-party rights
  • Customer Business Data uploaded or stored within the Services



22. Force Majeure


Topcone shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, acts of government, labor disputes, internet failures, cyberattacks, utility failures, pandemics, or cloud infrastructure outages.



23. Governing Law


These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles.



24. Dispute Resolution


Before initiating formal legal proceedings, both parties agree to make reasonable efforts to resolve disputes through good-faith negotiations.
If a dispute cannot be resolved informally, either party may pursue available legal remedies in the state or federal courts located in California, unless otherwise agreed in writing.



25. Changes to These Terms


Topcone may update these Terms from time to time.
Material changes will become effective upon publication on our website or through notice within the Services.
Continued use of the Services constitutes acceptance of the revised Terms.
